Privacy Policy

Duran Consulting respects individual privacy. This policy explains how Duran Consulting treats the personal information it obtains from customers, prospective customers, and other users of the Duran Consulting Web Site (the “Duran Consulting Site”). This policy is part of the terms and conditions that govern use of the Duran Consulting Site. The Duran Consulting Site makes information and resources available to its present and prospective customers and the general public. As used in this Privacy Policy, “You” refers to you as a user of the Duran Consulting Site, whether You are acting on Your own behalf or as a representative of another person or entity. 

The Information We Obtain. Duran Consulting collects the information it needs from: (a) prospective clients to determine whether Duran Consulting’s services may be appropriate for them; and (b) clients to provide them each with the services they request. 

If You request information or services from Duran Consulting, You will be asked to provide the information Duran Consulting needs to respond to Your request. Information, including personal information, may be sought from You in meetings, by telephone, using email, through the Duran Consulting Site, and in other routine, lawful operations that Duran Consulting uses in the ordinary course of conducting its business. No one is required to provide any information to Duran Consulting at any time. However, if You do not provide Duran Consulting with the information it requests, it may not be possible to provide You with the information or services You have asked for. In other cases, Your decision not to provide Duran Consulting with information may limit the services Duran Consulting is able to provide to You.

How Duran Consulting Uses The Information Provided. Duran Consulting uses the information it obtains to:

1. Discuss its services with prospective clients; 2. Provide the professional services its clients request; 3. Develop new and updated services and information resources; and 4. Administer, protect, and manage the Duran Consulting Site, Duran Consulting’s services and information resources, including without limitation, its intellectual property rights and interests.

We may use and disclose de-identified information derived from clients for promotional, communications, and other business purposes. Duran Consulting has a strict policy of not using personally identifying or identifiable information of its clients or former clients for promotional purposes or in any public communication. In the unlikely event that this policy changes, Duran Consulting will seek Your consent prior to making any use of any personally identifiable information You may have provided other than those specified in this policy. 

Disclosures of Information. Duran Consulting may disclose certain information it obtains in order to provide certain services solely as its agreements with its clients permit. As an example and without limitation, Duran Consulting may disclose certain personal information it obtains from the employees of corporate or institutional clients to the management of those clients. Duran Consulting may also disclose information as it believes necessary to: (a) comply with applicable law and regulations, which may include disclosures made in response to any subpoena, document request, or other legal request seeking the disclosure of information that appears to have been lawfully issued; (b) perform under and enforce agreements under which its services are provided; and (c) otherwise exercise Duran Consulting’s legal rights. The information Duran Consulting obtains is not sold, rented, or disclosed to any person or entity except as this policy states. 

Security. Duran Consulting uses appropriate security measures to protect the personal information we obtain from unauthorized alteration, loss, disclosure, or use, including technological, physical and administrative controls over access to the systems it uses to provide professional services. As an example, Duran Consulting restricts access to client information to the agents of the business whose duties require them to have it. To obtain this access, agents are required to agree not to: (a) disclose that information; or (b) use their access to client information except to perform under their respective agreements with Duran Consulting. 

Retention of Information.
Duran Consulting retains the information it obtains for a period sufficient to provide and administer the services that Duran Consulting’s clients request, as necessary to comply with its legal obligations, and as Duran Consulting otherwise deems appropriate for the purposes described above.

Complaints will be acknowledged, investigated, resolved between Duran Consulting and the parties concerned when possible, and reported to governmental authorities as the applicable law requires and as appropriate.
 
Changes to this Policy.
Duran Consulting may change this policy at any time. You are welcome to contact Duran Consulting at any time with any questions You may have about this policy, including questions as to whether the posted policy has been changed. Unless a notification of the change in policy states otherwise, changes to this policy are effective as of the date and time posted.  Policy Effective Date: July 1, 2010
